Terms of Service for GameSpeed Insight Inc. Applications
Effective Date: March 13, 2026
Please read these Terms of Service ("Terms") carefully before using any applications published by GameSpeed Insight Inc. ("we," "us," or "our").
Covered Applications:
These Terms apply to all applications published by GameSpeed Insight Inc., including but not limited to:
• BaGSS (Baseball Game Situation Simulator)
• BaGSS Flash Cards
• Other GameSpeed baseball training applications
Throughout these Terms, "the app" or "our apps" refers to any GameSpeed Insight Inc. application.
1. Acceptance of Terms
By downloading, installing, or using our apps, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our apps.
For users under 18 years of age: By using our apps, you confirm that you have obtained permission from your parent or legal guardian to use the app and agree to these Terms.
2. License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use our apps for personal, non-commercial purposes in accordance with these Terms.
You may NOT:
• Modify, reverse engineer, decompile, or disassemble the app
• Copy, distribute, or create derivative works from the app
• Remove or alter any copyright, trademark, or proprietary notices
• Use the app for any illegal or unauthorized purpose
• Sell, rent, lease, or sublicense the app to any third party
• Use the app in any way that could damage, disable, or impair our servers or networks
3. Subscriptions and Purchases
3.1 BaGSS Flash Cards Premium Subscription
BaGSS Flash Cards offers a Premium subscription for $9.99/year (or other pricing as displayed in the app).
Note: BaGSS (Baseball Game Situation Simulator) is NOT a subscription service. The subscription terms below apply only to BaGSS Flash Cards Premium.
Subscription Terms for BaGSS Flash Cards Premium:
• Payment is charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings
• Cancellation takes effect at the end of the current billing period
• No partial refunds for unused portions of a subscription period
3.2 Free Tier
BaGSS Flash Cards offers a free tier with limited content (S1 & S2 scenarios). The free tier may be modified or discontinued at any time without notice.
3.3 Pricing Changes
We reserve the right to change subscription pricing at any time. Price changes will apply to new subscriptions and renewals after the change takes effect. Current subscribers will be notified of price changes in advance.
4. User Content and Conduct
4.1 Your Responsibilities
You are responsible for:
• Maintaining the security of your device and Apple ID
• All activity that occurs through your account
• Ensuring your use complies with applicable laws
4.2 Prohibited Conduct
You may NOT:
• Use the app to violate any local, state, national, or international law
• Share your subscription access with others
• Attempt to circumvent any subscription or payment mechanisms
• Interfere with or disrupt the app or servers
• Use automated systems or software to extract data from the app
5. Intellectual Property
5.1 Ownership
All content in our apps, including but not limited to text, graphics, images, diagrams, logos, baseball scenarios, training content, software, and trademarks, are owned by GameSpeed Insight Inc. or our licensors and are protected by copyright, trademark, and other intellectual property laws.
5.2 Trademarks
"GameSpeed," "BaGSS," "Baseball Game Situation Simulator," and related logos are trademarks of GameSpeed Insight Inc. You may not use these trademarks without our prior written permission.
5.3 Limited License
Your use of the app does not grant you ownership of any content, code, data, or materials you access through the app.
6. Educational Use Only
Our apps are designed for educational and training purposes in baseball defensive positioning and strategy. The content is provided for general information and skill development.
• The app is not a substitute for professional coaching or instruction
• Users assume all risk when applying techniques learned in the app
• We are not responsible for injuries or damages resulting from use of the app or application of techniques learned
7. Disclaimers and Limitation of Liability
7.1 "As Is" Basis
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
7.2 No Guarantee
We do not guarantee that:
• The app will be uninterrupted, timely, secure, or error-free
• The results obtained from using the app will be accurate or reliable
• Any errors in the app will be corrected
• The app will meet your specific requirements
7.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMESPEED INSIGHT INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
• Your use or inability to use the app
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the app
• Any bugs, viruses, or other harmful code that may be transmitted to or through the app
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the app
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRIOR TO THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.
8. Indemnification
You agree to indemnify, defend, and hold harmless GameSpeed Insight Inc., its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:
• Your access to or use of the app
• Your violation of these Terms
• Your violation of any third-party rights
• Any claim that your use of the app caused damage to a third party
9. Updates and Modifications
9.1 App Updates
We may from time to time provide updates, enhancements, or modifications to the app. You may need to update third-party software or hardware to continue using the app.
9.2 Content Changes
We reserve the right to modify, suspend, or discontinue any part of the app or any content at any time without notice or liability.
9.3 Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
• Posting the updated Terms in the app
• Updating the "Effective Date" at the top of these Terms
• (If applicable) Providing notice through the app or other means
Your continued use of the app after changes become effective constitutes acceptance of the updated Terms.
10. Termination
10.1 Termination by You
You may stop using the app at any time. Deleting the app from your device terminates your license to use it.
10.2 Termination by Us
We reserve the right to suspend or terminate your access to the app at any time, with or without cause or notice, including if:
• You violate these Terms
• We are required to do so by law
• We discontinue the app
10.3 Effect of Termination
Upon termination:
• Your license to use the app immediately ends
• You must stop all use of the app and delete it from your devices
• Termination does not entitle you to a refund of any fees paid
• Sections of these Terms that by their nature should survive termination shall survive
11. Governing Law and Dispute Resolution
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions.
11.2 Dispute Resolution
Any dispute arising from these Terms or your use of the app shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property infringement.
11.3 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
12. Apple App Store Terms
If you downloaded the app from the Apple App Store, you acknowledge and agree that:
• These Terms are between you and GameSpeed Insight Inc., not Apple
• Apple has no obligation to provide maintenance or support services for the app
• Apple is not responsible for any product warranties
• Apple is not responsible for addressing any claims by you or third parties relating to the app
• Apple is not responsible for investigation, defense, settlement, or discharge of any third-party intellectual property infringement claim
• You must comply with applicable third-party terms when using the app
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you
13. General Provisions
13.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and GameSpeed Insight Inc. regarding the app.
13.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
13.3 Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
13.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
13.5 No Agency
No agency, partnership, joint venture, or employment relationship is created as a result of these Terms, and neither party has any authority to bind the other in any respect.
